Interesting way to get hit by a train

A car carrying two passengers was rear-ended by an Amtrak train carrying 134 passengers and 10 crew members at approximately 1:30 a.m. Saturday after becoming high-centered on the train tracks.
According to a report by the North Dakota Highway Patrol, the car, driven by 21-year-old Tabitha Carlson, entered a private service road on the north side of the train trestle on Ward County Highway 12 west of Minot, and after making a right turn, became high-centered on the train tracks.
Shocking, the driver was under the influence.
 
Wow...that's just...wow. I'm assuming it was the Empire Builder unless Amtrak snuck a train on the line no one knows about.

Do I have it right?

To be hit by a train be on the tracks when the train is coming.

To not be hit by a train be off the tracks when the train is coming.

If the engineer runs the train when it is not on the tracks, he is in deep doo-doo.

Are those the rules?
 
We looked in the GCOR and didn't find anything about riding higher on the rails, is this something new, or is this only done in the higher elevations ???

Maybe the rails are lower down here in SOUTH Louisiana (elevation 35 ft) than in NORTH Dakota (elevation 1900ft) ???

Wish reporters would get these things correct - or is that part of the mystique of being a reporter ??? Then they always put the train to blame, why is that ??? At least these people were charged with criminal tresspass.
